Agreement to Terms
By using secretsanta.email ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
Description of Service
secretsanta.email provides a tool for generating Secret Santa pairings and sending assignment emails to participants. The service is provided on an as-is, best-effort basis.
User Responsibilities
When using the Service, you agree to:
- Provide accurate and complete information
- Only include names and email addresses of people who have consented to participate
- Use the Service for lawful purposes only
- Not attempt to circumvent our security measures or payment systems
- Not use the Service to send spam or unsolicited emails
- Respect the privacy and preferences of all participants
Email Delivery Disclaimer
Test Email
A test email is provided to help confirm basic reachability. Receipt of the test email does not guarantee that participant emails will be delivered successfully.
Delivery Limitations
Email deliverability depends on factors beyond our control, including:
- Recipient server configuration
- Spam filtering
- Security policies
- Typographical errors in email addresses
- Recipient mailbox availability
We do not guarantee delivery of emails to all participants and are not liable for failed or delayed delivery.
Payment Terms
- Fee: Each Secret Santa draw costs $5 USD, payable before the draw is conducted
- Payment processing: Payments are processed securely through Stripe
- Refunds: Refunds may be granted at our discretion when a clear service failure occurs. Contact support@secretsanta.email for refund requests.
- Refunds will not be issued for:
- Incorrect or misspelled participant email addresses
- Spam filtering by recipient servers
- Non-responsiveness of participants
- Issues reported after draw data has been deleted per our retention policy
Service Availability
We strive to provide reliable service, but we cannot guarantee:
- 100% uptime or availability
- Email delivery to all recipients (delivery depends on recipient email providers)
- Compatibility with all email systems or spam filters
Intellectual Property
The Service, including its design, code, and content, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.
Privacy and Data Protection
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.
Prohibited Uses
You may not use the Service to:
- Send emails to people without their consent
- Conduct illegal activities or facilitate fraud
- Harass, abuse, or harm others
- Distribute malware or malicious content
- Violate any applicable laws or regulations
- Interfere with or disrupt the Service
Disclaimers
The Service is provided "as is" without warranties of any kind. We disclaim all warranties, express or implied, including but not limited to:
- Merchantability and fitness for a particular purpose
- Non-infringement of third-party rights
- Accuracy, reliability, or completeness of the Service
- Uninterrupted or error-free operation
Limitation of Liability
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the Service.
Our total liability for any claim related to the Service shall not exceed the amount you paid for the specific draw in question.
Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Your failure to obtain proper consent from participants
Governing Law
These Terms are governed by and construed in accordance with the laws of Sweden, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Sweden.
Changes to Terms
We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after such changes constitutes acceptance of the new Terms.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
